By using the Yellowtag.com website ("the website", www.Yellowtag.com) you are agreeing to the terms that appear below, whether or not you register as a user. If you have any questions please contact support team.

1) Introduction

The website is owned and operated by Yellowtag Limited, a company registered in the UK, number 3881165. Yellowtag Ltd asserts all rights to copyright, trademarks and to any and all intellectual property rights.

As a user you will be able to access material on most areas of the website without going through the registration process. Certain areas of the website are only open to you if you register. Although the Yellowtag notification service is free; tags and related products are available on a chargeable basis only. Chargeable products will be clearly identified and if you decide to make a purchase you will be asked to provide information relating to your preferred method of payment. The content of your personal portfolio and information about your payment are maintained and operated on a secure server. Additional provisions relating to purchases are set out in Section 7 of these terms.

Registered users of the Yellowtag service will have access to the email address registered to their personal portfolio. However, the use of the email address in a registered user's portfolio will be deemed to have lapsed if the user has not renewed the subscription for time limited tags. Yellowtag Ltd reserves the right to suspend or terminate a registered user's account without reason and with or without notice where fraud or abuse of the service is suspected. In the event of such suspension notice will be given to your last known primary email address, as notified to Yellowtag. In that event, notice will be deemed to be served twenty-four hours after transmission or posting to that address..

2) Use of Yellowtag.com content

All material on the website ("the content") belongs to Yellowtag Limited. You may receive and display the content from the website on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your personal, non-commercial use.

Except as expressly set out above, you may not reproduce, modify or commercially exploit any of the content. In particular, but without limiting the general application of the restrictions contained in the preceding paragraph, you may not do any of the following without prior written permission from Yellowtag Limited:

• Redistribute any of the content (including by using it as part of any library, archive or similar service)

• Remove the copyright or trademark notice from any copies of the content made under these terms

• Create a database in electronic or structured manual form by systematically downloading and storing all or any of the content

• Copy or mark the Yellowtag email addresses from Yellowtag products to a label an item or a product for the purposes of using Yellowtag service to protect the item.

3) Intellectual Property

You acknowledge that Yellowtag is a registered trademark of Yellowtag Limited. You may not reproduce it or use it without written permission from Yellowtag Limited.

The designs of all tag, related Yellowtag products and the phrases 'the search engine for lost property' and 'consider it found' are protected by copyright and registered design. You may not use or copy them without written permission from Yellowtag Limited.

The Yellowtag business model is the subject of a pending patent application.

4) Registration

On registration, you must provide Yellowtag with accurate and complete registration information and it is your responsibility to inform Yellowtag Limited of any changes to that information (in particular your email address and other contact information). Changes to your details should be made directly to your personal portfolio maintained on the Yellowtag secure server. Yellowtag Limited cannot be held responsible for any failure to contact you if your personal portfolio details are incorrect.

Each registration is for a single user only. On registration you will choose a user name and a password will be sent to your registered email address (collectively "your login details"). You are responsible for all access to the site made using your login details. You are also responsible for preventing unauthorised use of your login details. If you believe that there has been any breach of security such as the disclosure, theft or unauthorised use of your login details or payment information you must notify Yellowtag Limited immediately by email to support team.

5) Messages

You are solely responsible for the content of your messages. You must comply with any rules posted by Yellowtag Limited on the databases. In particular you may not:

• Email, send or otherwise publish any messages containing any form of advertising for goods or services

• Email, send or otherwise publish any messages that are unlawful, threatening, abusive, libellous, indecent, infringe the rights of third parties or which contain any other form of illegal content

• Email, send or otherwise publish any messages that contain a virus or other harmful component

• Restrict or inhibit any other user from using the service.

By submitting messages you agree to indemnify and hold harmless Yellowtag Limited from all claims, costs and expenses (including legal expenses) arising out of any messages emailed, sent or published by you that are in breach of this section 5.

By submitting messages you are granting Yellowtag Limited a perpetual royalty free non-exclusive licence to reproduce, make available, distribute and sub-license the message in whole or in part and in print or electronic form.

6) Service

Registration for the Yellowtag service entitles the registered user to the use of the email address printed on those Yellowtag's (provided the user has renewed their subscription when notified by Yellowtag Limited). Further supplies of tags and other products will be charged at prices ruling at time of despatch. Notification of the finding of a lost Yellowtagged article will be made to the registered user's primary email address, as provided to Yellowtag. Notification of the finding of a lost Yellowtagged article via a message system, other than the registered user's primary email address, (such as a mobile phone text message) selected by the registered user from the menu of messaging services may be charged according to the tariff ruling at the time of notification. Registered users may not use any email addresses allocated to them for any purpose other than the identification of their personal effects to facilitate retrieval in the event of their loss. The service may be suspended or terminated by Yellowtag Limited at any time with or without notice if any of these terms and conditions are infringed or if any payment due to Yellowtag Limited remains unpaid for more than seven days after the payment is due.

7) Chargeble Services

All supplies of tags and other products will be charged at prices ruling at time of despatch. Prices advertised on the Yellowtag.com website include VAT and all relevant taxes., Postage and packing is charged separately , the cost is shown at time of placing order. For deliveries outside of the UK the advertised price includes postage and packing at the prevailing rates. Registered users who have expressed a preference for receiving notifications of finds by mobile phone messaging services or similar services (other than to their primary email address,) may be charged for these notifications according to the tariff published on the Yellowtag website ruling at the time of the notification. Charges will be made to the registered user's credit card in pounds sterling or an appropriate local currency for the user at If the payment fails for any reason the registered user's access to the Yellowtag service may be suspended or terminated without notice. If your Yellowtag service is suspended or terminated for any reason you will not be entitled to any refund of any payments already made to Yellowtag Limited. Prices or values prefixed '£' or suffixed GBP are denominated in UK pounds sterling. Prices or values prefixed '$' are denominated in US dollars.

8) Limitation of Liability and Disclaimer

The Yellowtag service is designed as a property marking system that will simplify the process by which a finder of lost property can contact the owner and agree arrangements with you for the return of that property. However, the use of the service is beyond the control of Yellowtag Limited who cannot therefore offer any guarantee that Yellowtagged property will be returned to its owner. Yellowtag Limited cannot enter into or be responsible for any arrangements for the return of any property.

Yellowtag Limited will not be liable for any damages (including without limitation, damages for loss of profits) arising in contract, tort or otherwise from your use or inability to use the website or any content or from any action taken (or refrained from being taken) as a result of using the website or any content. The website contains links to other World Wide Web sites, either directly or through frames and, where possible, we will make clear where such links are being made. Those websites are provided by independent third parties and Yellowtag Limited is not responsible for their availability, content or service. Yellowtag Limited makes no warranty that the website is free from infection by viruses or anything else that has destructive or contaminating properties.

Yellowtag Limited will use its best endeavours to ensure that its server is always available for the transmission of emails, the maintenance of the security of its databases and the operation of the website. However, any failure of the server to provide these services is beyond Yellowtag Limited's control and the company cannot therefore be held liable for any failure or disruption to the service.

Yellowtag Limited will send a notification by email to the owner of the Yellowtag email address the owner of the property whenever a message arrives on its servers addressed to the Yellowtag email address registered to the owner. Our servers are programmed to execute these notifications every 15 minutes. Yellowtag doesn't warranty that the message will reach the owner within 15 minutes or that it will reach the owner within any guaranteed period.

SMS messaging is handled by third parties and Yellowtag Limited sends an electronic message to a SMS service provider which is transmitted by them to the user's mobile phone. Yellowtag systems assumes no liability for failure of third parties to forward the SMS text message to the user

Yellowtag Limited will also use its best endeavours to prevent breaches of security caused by 'hacking' but does not warrant that the system is impregnable to such attack and will not be liable for any consequences of such an attack.

In all circumstances the total liability of Yellowtag Limited is restricted to refund of the cost of products or service purchased from Yellowtag. No other direct or indirect liability is assumed or implied.

9) Privacy Policy

The information that you provide about yourself to Yellowtag Limited will only be used by Yellowtag Limited in accordance with its Privacy Policy Statement, which can be accessed on this website. This includes:

• Using your information for the effective administration of the website and to communicate with you.

• The disclosure of your information to selected companies if you have given Yellowtag Limited permission to do so

You may change your wishes about whether you want your information held by Yellowtag Limited disclosed to third party organisations at any time by making the appropriate change in your personal portfolio details. If you make a change from allowing disclosure to preventing disclosure Yellowtag Limited will remove your details from disclosure within 14 days of your notification. However, Yellowtag Limited has no control over the use of your information that has already been released to third party organisations.

Regardless of whether you have selected disclosure of your information to third party organisations or not Yellowtag Limited may at its sole discretion provide any information held about you to relevant law enforcement agencies having due cause to request such information.

By registering as a user of the Yellowtag service you are accepting the terms of the Yellowtag Limited privacy policy. Yellowtag Limited reserves the right to amend its Privacy Policy from time to time. These changes will be published on the 'Privacy Policy' web page.

10) Changes to these Terms

Yellowtag Limited reserves the right, at its discretion, to make changes to any part of the website or its functionality at any time with or without notice. When terms are changed (including changes to the Privacy Policy Statement) Yellowtag Limited will notify you by publishing the changes on the web site. If you use the website after publication of the changes on this web site you are agreeing to be bound by the new terms. If you do not agree to the new terms you should not make any further use of the website or the Yellowtag service.

11) Advertising and Sponsorship

Parts of the website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the website complies with international and national law. Yellowtag Limited will not be responsible for any error or inaccuracy in any advertising or sponsored material.

12) Competitions and Prize Draws

From time to time Yellowtag Limited may run competitions, free prize draws and promotions ('competitions') on the website. These are subject to additional terms and conditions that will be made available at the time of the competition. Competitions are only open to registered users of the Yellowtag service. No purchase is necessary. You may only enter competitions if the legislation in your state, territory or country permits you to do so.

13) Applicable Law

These terms shall be governed by and construed in accordance with English law.

The parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute, which may arise out of, under or in connection with these terms, or the legal relationship established by them and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.

For the exclusive benefit of Yellowtag, Yellowtag Limited reserves the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these terms are entered into in the course of your trade or profession, the country of your principal place of business.

14) General

You may not assign, sub-license or otherwise transfer any of your rights under these terms.

If any of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.

Headings in these terms are for convenience only and will have no legal meaning or effect.

Yellowtag finders Prize Draw Terms and Conditions

1) This prize draw is open to all Yellowtag members worldwide except where local legislation prohibits entry to such competitions.

2) Employees and their families of Yellowtag Limited, their agencies or any other companies directly connected with the administration of the prize draw are not permitted to participate in the prize draw.

3) Permission from a parent or guardian must be given for any child under the age of 16 to enter the prize draw.

4) No entrant may win more than one prize.

5) By entering this prize draw entrants will be deemed to have accepted and agreed to be bound by the terms and conditions.

6) No purchase necessary.

7) All entries must be received by 31 December of the year in which the competition is published.

8) Entries will only be accepted via the Internet. The promoter will not accept proof of submission as proof of receipt.

9) No trade, consumer groups or third party entries accepted.

10) The size of the eventual prize would be calculated on the basis of £10 per entry into the prize draw up to a maximum of £1000 for all entries. For example if there were only 100 entries, the maximum prize would be £1000. The first entry drawn at random after the closing date will be awarded a cheque for the prize or the local currency equivalent of the prize-winner at the prevailing rate of exchange on the closing date.

11) Winners will be notified by email within 90 days of the closing date.

12) A list of winners will be available by sending a stamped and addressed return envelope to the promoter, Yellowtag Ltd, 15, Gay Street Bath, BA1 2PH after 31 March but before 31 January of the subsequent year.

13) The promoter's decision is final. No correspondence will be entered into.

14) These terms will be governed by and construed in accordance with English law.
